Douala: Minister & City Mayor at loggerheads over Public Procurement Commission chairman’s suspension

The Minister of Public Contracts, Ibrahim Talba Malla, and the Douala City Mayor are at loggerheads following the suspension of Henri Etoa Mussongo as chairman of the Internal Public Procurement Commission.

On April 11, 2022, Roger Massa, Douala City Mayor, signed a note, ordering the suspension of Henri Etoa.



Informed of the move, Ibrahim Talba Malla on April 14 addressed a letter to the City Mayor, urging the latter to reconsider his decision and reinstate Henri Etoa to his position as chairman of the Internal public procurement commission.

After two months during which no action was taken to implement his request, the Minister in another letter, based this time on article 194 of the law governing public contracts in Cameroon, threatened the City Mayor that failure to reinstate Henri Etoa would result in his removal as executor of public works under the Douala City Council.


According to Abdel Aziz, a lawyer at the Cameroon Bar Council, the law does not permit a City Mayor to suspend an agent of the ministry irrespective of his offense. Rather, in the case of misunderstanding between both parties the mayor is required to either address the situation to the ministry directly or to the agency for the regulation of public contracts.


It should further be noted that Henri Etoa Mussongo was appointed chairman of the Internal public procurement commission by the minister of public contacts.
